Hoffmann & Baron Obtains Summary Judgment Ruling For MedShape, Inc.
Hoffmann & Baron successfully defended MedShape, Inc. (“MedShape”) in a patent infringement lawsuit brought by Cayenne Medical, Inc. (“Cayenne”) involving methods and orthopedic devices for attaching soft tissue to bone. Cayenne alleged that Medshape’s ExoShape® FEMORAL Soft Tissue Fastener infringed Cayenne’s patent. Hoffmann & Baron moved to dismiss Cayenne’s infringement allegations, arguing that the claims of the asserted patent were indefinite, and therefore invalid under 35 U.S.C. § 112.
In an opinion dated May 6, 2016, Judge Holland of the U.S. District Court for the District of Arizona, agreed with the arguments advanced by Hoffmann & Baron, and granted MedShape’s summary judgment motion of invalidity, finding the claims of the asserted Cayenne patent were indefinite.
