Hoffmann & Baron Obtains A Permanent Injunction and Attorney Fees for OSN Labs, LLC in a Trademark Infringement Litigation

Hoffmann & Baron successfully enforced OSN Labs, LLC’s (“OSN”) BLACKOUT^® trademark against Phoenix Energy, LLC (“Phoenix Energy”) in a trademark infringement, unfair competition, and false designation of origin litigation.  Specifically, in an Order dated January 5, 2024, Judge Liburdi of the U.S. District Court for the District of Arizona granted OSN’s motion for default judgment, agreed that Phoenix Energy’s distribution, marketing, and sale of a competing sleep aid product willfully infringed OSN’s BLACKOUT^® mark, and issued a permanent injunction.  Additionally, the Court agreed that OSN was entitled to its reasonable attorney fees under the Lanham Act.
