Hoffmann & Baron Wins Patent Infringement Trial For Hi-Tech Pharmaceuticals, Inc.
Hoffmann & Baron successfully defended Hi-Tech Pharmaceuticals, Inc. (Hi-Tech”), a leading sports nutrition manufacturer, in a patent infringement action brought by Thermolife International, Inc. (“Thermolife”) involving dietary supplements containing the amino acids arginine and lysine in combination with antioxidants and other ingredients to enhance vascular function or physical performance. Thermolife, as exclusive licensee, alleged that Hi-Tech and other manufacturers of dietary supplements infringed four (4) patents owned by Stanford University.
After a 5-day trial, it was determined that the four (4) asserted patents were invalid. Notably, Judge Sammartino of the U.S. District Court for the Southern District of California subsequently granted Hi-Tech’s motion for attorney fees pursuant to 35 U.S.C. § 285.
